Wachira Wines – Wine Club Terms & Conditions

These Terms & Conditions (the “Agreement”) constitute a legally binding agreement between Wachira Wines, a California limited liability company, including its affiliates and subsidiaries (“Company,” “we,” “our,” or “us”), and you, the member (“Member,” “you,” or “your”), governing your participation in the Wachira Wine Club (the “Club”).

By enrolling in the Club, you agree to be bound by these Terms & Conditions, our Website Terms of Use, and our Privacy Policy, each incorporated herein by reference.

 


 

1. Eligibility

  • You must be 21 years of age or older to join.

  • An adult 21+ must sign for any wine delivery.

  • Membership is currently available in the following states: AK, AZ, CA, CO, CT, DC, FL, GA, HI, IA, ID, IL, KS, MA, MD, ME, MI, MN, MO, MT, NC, ND, NE, NH, NM, NV, NY, OR, PA, SC, TN, TX, VA, VT, WA, WI, WV, WY.

  • We reserve the right to suspend shipping to states where law or regulation prohibits or restricts direct-to-consumer wine shipments.

2. Membership & Automatic Renewal

  • Membership is an automatic renewal program under California law.

  • By joining, you authorize us to charge your designated payment method for each scheduled Club Selection until you cancel.

  • Charge Timing: Your payment method will be charged on or about the first of the applicable Club Selection month (prior to shipping or pick-up). You are responsible for notifying us of any changes to billing or updating that information on your Club Membership account


Membership Fee (New Members Only)

  • A $15 membership fee will be charged to new members enrolling on or after Jun 1, 2026 in connection with each scheduled Club Selection. This fee will be applied at the time of each Club Selection billing and is in addition to the cost of the wine selection(s).

  • This fee does not apply to existing members who joined the Wine Club prior to this date.

  • This fee supports an enhanced Wachira Wines experience including: 

    • Access to exclusive member experiences.

    • Preferred pricing on events and select offerings

    • Invitations to curated gatherings and shared experiences throughout the year.

    • Recognition of member milestones including birthdays and wine club anniversary years.

  • For members receiving shipments, experiences may be delivered through curated at-home offerings and exclusive access.

  • Pickup party access is not included in this fee

Note: Wachira Wines reserves the right to modify membership offerings for new enrollments without affecting the terms of existing memberships.

  • Club Selection Frequency: Club Selections occur six (6) times per year (February, April, June, August, October, December).

  • Minimum Commitment: Members agree to receive a minimum of three (3) Club Orders before cancellation.

3. Holds and Cancellations

  • You may request to place your membership on hold for a temporary period by emailing email wineclub@wachirawines.com. During a hold, no club selections will be processed or billed.

  • You may cancel your membership at any time after fulfilling the minimum commitment mentioned above.

  • To avoid charges, cancellations must occur 72hrs before billing of the next scheduled shipment.

  • Cancellation may be made by logging into your Club Membership account or emailing wineclub@wachirawines.com

California Automatic Renewal Law (ARL) Disclosure:

  • This is an automatic renewal program.

  • By enrolling, you consent to recurring charges until you cancel.

4. Club Selections

  • Selections will consist of curated wines based on membership tier, as follows:

    • Silver: 2 bottles, select varietals

    • Gold: 4 bottles, select varietals

    • Platinum: 6 bottles, select varietals.

  • You will receive an email of your upcoming Club Selection approximately two weeks before billing.

  • Prior to billing, you may customize your order (within the wine options available) from your Club Membership account. Once billed, no changes or refunds are permitted.

  • If a wine is unavailable, we may substitute a comparable product of equal or greater value.

5. Pricing & Discounts

Members enjoy the following benefits (subject to change with notice):

  • 30% off your first club order

  • 20% savings on wine, winery experiences, and merchandise.

  • 20% savings on all Wine Club Selections.

  • 30% savings on purchases of 24+ bottles (2 cases).

  • Complimentary tasting (1 glass for up to 2 people) at Wachira Wines Pickup Parties.

  • Exclusive access to member-only events, limited releases, and promotions.

  • Shipping discounts on 12 or more bottle orders.

6. Shipping & Pickup

  • At initial wine club membership registration, you must select shipping or pickup.These options can be changed at any time from your Club Membership Account

  • Pick-up Option: If you select the pick-up option, you have 60 days to pick up your wines, otherwise they will be shipped to the address on your account and the card on file will be charged for shipping costs. Pick-up locations and events may vary and will be communicated to members in advance. After 60 days, your wine selection may be subject to substitution based on availability.

  • Shipping Option and Address Changes (see our Shipping Policy for estimated timelines): You are responsible for notifying us of changes to your shipping information or updating your details in your Club Membership account. Fees due to incorrect delivery, forwarding, or returns will be charged to the card on file.

  • Refused shipments are subject to reshipping fees.

7. Payment & Taxes

  • You represent and warrant that you have the legal right to use the payment method provided.

  • Applicable sales tax is charged based on delivery location.

  • If a charge is declined, all shipments will be suspended until the issue is resolved.

8. Returns & Refunds

  • No refunds are permitted after billing (see our Refund Policy for details).

  • If a bottle is damaged or defective, we may replace it with a comparable bottle.

9. Privacy & Communications

  • By joining, you consent to receive club-related and promotional communications (email, phone, or text), subject to opt-out rights under California law.

  • Your personal information is handled in accordance with our Privacy Policy and your rights under the California Consumer Privacy Act (CCPA/CPRA).

  • You may opt out of promotional communications at any time.

10. Prohibited Use & Membership Termination

  • Wine Club Memberships are for personal, non-commercial use only.

  • Membership benefits are non-transferable.

  • We may terminate or suspend your membership at our discretion, including for violation of these Terms, unlawful activity, or misuse of benefits.

11. Modifications

We reserve the right to:

  • Modify benefits, discounts, and events with 30 days’ notice.

  • Revise these Terms & Conditions at any time.

Continued participation after notice constitutes acceptance of changes.

12. Governing Law & Dispute Resolution


  • This Agreement shall be governed by the laws of the State of California.

  • Any disputes shall be resolved through binding arbitration in Alameda County, CA, under the rules of the American Arbitration Association, except where prohibited by law.

  • Nothing herein waives your rights under California law.

Wine Club Terms & Conditions – Summary

By joining the Wachira Wine Club, you are committing to pay for and receive at least three (3) Club Selections before cancelling. You also agree to the following:

  1. Age Requirement:

    1. You must be 21 or older to join. An adult (21+) must sign for deliveries.

  2. Automatic Renewal:

    1. Your membership is a subscription that renews automatically.

    2. Your payment method will be charged six times per year (Feb, Apr, Jun, Aug, Oct, Dec).

  3. Charges & Shipments:

    1. You’ll receive 2, 4, or 6 bottles per Club Selection depending on your membership level.

    2. New Member Fee: New members enrolling on or after June 1, 2026 will be charged a $15 fee with each Club Selection (6 times per year), in addition to the cost of the wine. This fee does not apply to existing members who joined the Wine Club prior to this date.

  4. Membership Hold/Cancellation:

    1. You may request to temporarily pause your membership by emailing  wineclub@wachirawines.com

    2. You may cancel your membership at any time after fulfilling the minimum commitment mentioned above.

    3. To cancel, log into your Club Membership account or email wineclub@wachirawines.com

    4. To avoid charges, it is highly recommended that you cancel 72 hours before billing for the next Club Selection.

  5. Refunds:
    No refunds after billing. If a bottle is damaged or defective, we may replace it.

  6. Privacy and Communication:

    1. We may send you emails, texts, or calls about your membership.

    2. You can opt out of marketing communications at any time.
